In what looks like another attack on the U.S. judicial system, Trump said he would “absolutely” split up the federal appeals court that blocked one of his most cherished executive actions.
While reporting the president’s plan to revamp the 9th Circuit Court of Appeals, CNN made a subtle correction:
All joking aside, the president is dead serious about breaking up the federal court whose judges put on halt his travel ban. He said so in an interview with the Washington Examiner. He added that “many [other] people” want to dismantle the court because it is simply “outrageous.”
Trump Lashes Out at the Ninth Circuit
Trump complained that all his political rivals now have to do is “run to the 9th Circuit”. He underlined that the U.S. judicial court system is quite wide, and his opponents could pick any other location.
But they immediately run to the 9th Circuit. Because they know that’s like, semi-automatic,
the president added.
Trump made the remarks just one day after U.S. District Judge William Orrick temporarily put on hold his plan to strip “sanctuary cities” of federal funding if they keep refusing to cooperate with federal immigration agencies.
Orrick ruled that the Trump administration has no authority to instruct the Justice Department to attach conditions to grants for the said municipalities. If the feds appeal the case, it will land in the 9th Circuit.
Other 9th Circuit judges blocked both versions of Trump’s travel ban on Muslim visitors coming from predominantly Muslim countries.
Trump complained that the language used in those executive orders was so clear that even a “reasonably good” first grader would fully understand it. Yet, courts rejected the orders for the wording but they failed to mention in the rulings which words were improperly used, Trump said.
Trump Upset Court Blocked His Sanctuary City Order
The Commander in Chief continued his tirade by complaining about the sanctuary city decision. He noted people are being killed by felons who should be deported but sanctuary cities keep harboring them. Trump added that the Ninth Circuit Court of Appeals is based in San Francisco “in the same general area” Kate Steinle was shot and killed by an undocumented immigrant who had been deported five times before the killing. San Francisco is also considered a “sanctuary city”.
On Wednesday, Trump said sanctuary cities were “very, very bad” and a “disaster”. Yet, Trump is not the only Republican to take aim at the 9th Circuit for being too liberal.
The GOP has unsuccessfully tried to trim the court’s jurisdiction and create a new court that would help the 9th Circuit with its caseload. The 9th Circuit’s appeals jurisdiction covers nine states on the West Coast and a pair of U.S. territories. It has 25 judges, of whom Democratic leaders appointed 18.
Trump also said Wednesday, that Democrats have resorted to “judge shopping” in a bid to find a court that sides with them on controversial issues. The president cited a report that the SCOTUS overturns 80% of the Ninth’s decisions. “What’s going on in the 9th Circuit is a shame,” Trump concluded.
