President Donald Trump’s lawyer Rudy Giuliani schooled himself on Friday morning – with his past self – after CNN host Chris Cuomo played video from 1998 showing the former New York mayor’s very different opinion on presidential subpoenas.
During an interview with George Stephanopoulos earlier this month, Giuliani claimed that Trump doesn’t have to comply if Special Counsel Robert Mueller subpoenas him to testify under oath. He said:
“We don’t have to. He’s the president of the United States. We can assert the same privileges other presidents have.”
That’s now, but it’s not the same opinion Giuliani had in 1998 when he was asked if then-President Bill Clinton would have to comply with a subpoena to testify.
Giuliani was once again asked about Trump complying with a subpoena before Cuomo confronted him with his own words from 20 years ago. When Giuliani asked if Clinton would have to comply with a subpoena, he told Charlie Rose:
“You gotta do it. I mean you don’t have a choice.”
Giuliani then went on to say that the president should be treated the same under the law:
“Under the criminal law, everyone should be treated the same. And I know there are some people that say the president should be treated stricter. We used to have an era where the president was treated much more leniently. But I think the right answer is the president should be treated — as far as the criminal law is concerned, the president is a citizen.”
As the video played, Giuliani objected and whined.
“That’s really unfair! That’s extremely unfair what you’re doing right now! This is the reason people don’t come on this show!”

The fact is that past presidents have had to comply with subpoenas, and the Supreme Court has ruled that presidents are not above the law. After Clinton was served a subpoena, he agreed to testify under oath if the subpoena was withdrawn.
So, if Mueller subpoenas Trump, Trump would have to testify, and Giuliani knows it. That’s why he whined about his past words being used against him.
